| In der EU Kommissions-Sitzung vom 8. November hatte die Kommission berichtet, den gemeinsamen non-paper-Vorschlag der Industrie übernommen und den Mitgliedstaaten vorgestellt zu haben. Die 10 Kommentare der Mitgliedstaaten sollten verarbeitet und der Entwurf eines CBD-non-papers Ende 2022 zu Verfügung gestellt werden. Die Kommission hat ICADA in einem persönlichen Schreiben informiert, dass sie eine vollkommen neue Revision durchführt, deren Ergebnis in der März-Sitzung vorgestellt wird. Wir berichten darüber ausführlich auf der Vivanatur (siehe unten). Wir weisen erneut darauf hin, dass es sowohl ein EUGH-Urteil, als auch ein Gutachten einer deutschen Behörde gibt, das den Verkauf CBD-haltiger Kosmetikprodukte abzusichern scheint. |

| Mit dem Urteil vom 19.11.2020 stellte das EUGH fest, dass CBD natürlicher oder synthetischer Provenienz keine Droge gemäß UN Single Convention von 1961 ist. (siehe ICADA-Nachricht vom 03.11.20) Die Abteilung DG GROWTH der EU Kommission hatte im Februar 2019 eine anderslautendende Meinung vertreten (siehe ICADA-Mail vom 19.02.2019). Wir Industrievertreter habenbereits lange sachlich dagegen argumentiert, aber erst das EUGH-Urteil hat unseren Argumenten den notwendigen Schub verliehen. Die Abteilung DG GROWTH der EU Kommission ist nun diesen Argumenten am 1. Februar gefolgt und hat eine Stellungnahme veröffentlicht, dass die non-drug-Sichtweise nun auch für kosmetische Produkte gilt. Die laufende Nummer 306 der KVO-Anlage II bezieht sich nicht mehr auf CBD. Damit wäre hoffentlich ein Verwendungsverbot in der Kosmetik beendet Um den Weg von Cannabidiol in Kosmetik-Produkte vollständig frei zu machen, wird es eventuell noch einen „Call for Data“ geben, auf dessen Basis das SCCS ein Safety-Assessment anfertigen soll. Wir weisen darauf hin, dass innerhalb der EU Kommission die Diskussion über die legale CBD-Verwendung noch nicht beendet ist |

| ICADA reported in a variety of mails and in the ICADA news click here on the prohibition draft of the European Union commission based on the „single Convention on narcotic drugs of 1961“. The entire EU Commission document with definitions, explanations, prohibition arguments and the prohibition draft can be read here. We strongly recommend to take a note of it specially because of the complications caused by ongoing changes in the UN-document. Ready to ban are: Cannabis and Cannabis resin; Cannabis sativa, ext. (Substance) CANNABIS SATIVA FLOWER EXTRACT CANNABIS SATIVA FLOWER/LEAF/STEM EXTRACT CANNABIDIOl, plant-derived ICADA has been urged by various companies in Europe, to take action against the bans (focused on natural CBD) in the EU Commission and since ICADA has direct access to the EU Commission, we will file a documentation with the arguments against a ban and submit it to the Commission. The objective is, to keep CBD legal. Urgent prerequisite condition is however, that the companies concerned provide technical arguments against the prohibition.
